- TERMS, CONDITIONS, & SERVICES -
Membership Terms
1. Perth Hills Pilates reserves the right to change hours of operation, services offered and all fees and charges at any time, at its sole discretion and without prior notice to the client. Any such changes will be notified to you through the website and/or emailing your last known address.
2. You must keep Perth Hills Pilates informed of any change in your contact details, physical condition, or any other information relevant to your classes.
3. You agree to be bound by and to uphold the “Perth Hills Pilates Rules and Regulations”. You acknowledge that you have been provided with a copy of the current Guidelines. The Guidelines may be changed or updated by Perth Hills Pilates at any time at its sole discretion and without prior notice.
4. It is your responsibility to ensure that you correctly operate any studio facilities or equipment. If you are in doubt as to how to correctly operate or use any studio facilities or equipment, you must consult a Perth Hills Pilates staff member for assistance.
5. You acknowledge that no one has made any representations (whether verbal or written) to induce you to enter this Agreement and that no verbal agreements or understandings have been made with Perth Hills Pilates unless as set out in this Agreement.
6. You acknowledge that you have been given the option of choosing a membership based on a monthly billing agreement.
7. This agreement entitles the member to the usage of equipment and resources at Perth Hills Pilates in accordance with the T&C’s contained within. Failure to use the resources and equipment at Perth Hills Pilates does not exclude the member from other obligations contained in this agreement.
8. Guests of members will be charged a Single Casual Class and must create a profile on Glofox and sign the studio waiver.
9. You agree to receive marketing correspondence via electronic transmission on a regular basis which may include (but not limited to) newsletters and promotional material.
Minimum Age
1. Classes are limited to persons who are at least 16 years of age. Clients less than 18 years of age must complete have a parent or guardian complete a consent form in the studio.
Time Freeze
1. Time Freeze is granted on written application for MEDICAL, PREGNANCY and BUSINESS RELOCATION reasons for a minimum period of one (1) week and weekly blocks thereafter, up to a maximum of twenty-six (26) weeks. The Freeze request must be accompanied by a doctor’s certificate (medical/pregnancy) or an employer’s letter (business relocation) at the time of the Freeze request. For all other reasons (including holidays), Time Freeze is granted on written application for a minimum of one (1) week and weekly blocks thereafter up to a maximum of twelve (12) weeks.
2. Requests for Time Freeze must be submitted to Perth Hills Pilates in writing no less than one (1) week prior to the commencement of the Freeze.
3. Members may not attend classes during the period of their requested freeze.
Cancellation of Membership
1. You agree that your Membership may be cancelled by Perth Hills Pilates if you do not adhere to the Guidelines, or your behaviour at Perth Hills Pilates is not acceptable or for any other reason that the management of Perth Hills Pilates decides is appropriate. Perth Hills Pilates reserves the right to refuse future Membership or Class Passes to you in these circumstances.
2. Except where set out elsewhere in this Agreement, cancellation within the Minimum Membership Term will forfeit any unused class passes. There are no refunds for any unused class credits.
3. The monthly direct debit automatically continues after the end of the Minimum Membership Term, unless your membership is canceled two (2) weeks prior to your next billing date, or anytime thereafter by notifying Perth Hills Pilates in writing of your intention to cancel.
Bookings & Appointments
1. Bookings must be made online to attend any class. When you cancel your class booking outside of 12 hours, your class credit is automatically returned. Bookings cancelled inside of 12 hours are classed as a "Late Cancel" and you will lose that class credit.
Waitlist
1. All classes have six (6) waitlist spaces available. If a space becomes available in the class, everyone on the waitlist will be notified. The first person to take action and BOOK the available spot, receives the place in class. The space is NOT automatically assigned to the first person on the waitlist.
Payment Terms
1. Payment must be made online prior to booking classes. We currently use payment processors as a Third Party Offering for internet-based payment services. Your Personal Information may be collected by such third parties directly and not by us, and will be subject to the third party’s privacy policy. We have no control over, and are not responsible for, third parties’ collection, use and disclosure of your Personal Information.
Hygiene & Cleanliness
1. For safety and hygiene reasons, clients must wear grip socks when using the equipment. These are available to purchase in the studio.
2. A clean sweat towel must be used at all times when training.
3. Clients should respect the health and safety of others when suffering from any infectious or contagious illness or disease. Where there is a risk (however small) of spreading the disease to other clients and/or guests in the studio, please re-schedule your class booking.
4. Reformer Beds and props are thoroughly sanitized immediately after, and in between classes.
Physical Condition
1. You acknowledge that you have completed a Pre-Exercise Questionnaire at the studio, before commencing your first class. You must notify Perth Hills Pilates of any change in your health so that your classes can be appropriately modified.
2. In the event of pregnancy, clients must notify Perth Hills Pilates and complete a Pregnancy Acknowledgement form before continuing to attend classes.
3. While a medical referral is not necessary to commence Perth Hills Pilates classes, we recommend that you discuss your wellbeing journey with your health care professional. You should seek medical attention if there are any unanticipated changes to your physical condition at any time.
4. You acknowledge that any advice and/or recommendations given to you, is not intended to constitute medical diagnosis or treatment. If you are in doubt you should seek medical advice prior to commencing classes.
5. You must not use any Perth Hills Pilates services whilst suffering from any infections or contagious illness, disease or other ailment or whilst suffering from any physical ailment such as open cuts, sores, or minor infections where there is a risk (however small) to other members and guests.
Member's Assumption of Risk
1. You are aware that your participation in classes conducted by Perth Hills Pilates may involve strenuous activity and special risks.
2. You warrant that you are physically able to participate in exercise classes and have not been advised otherwise by your medical practitioner. You further warrant that you have no pre-existing medical condition that would otherwise prevent you from using the studio services/facilities and/or participating in any classes/fitness program.
3. You understand that you will be engaging in activities that may involve risk of personal injury or illness. You also understand that there may be risks involved that are not known to you or to Perth Hills Pilates, or may not be reasonably foreseeable at this time or at the time of participating in classes. You assume the foregoing risks including risk of any negligence by Perth Hills Pilates and accept personal responsibility for any injury (including but not limited to personal injury and disability), illness, damage, loss, claim, liability or expense of any kind or nature, that you may suffer arising out of or in connection with the use of studio facilities or participation in classes/fitness programs by you, or any minor/person under your supervision, care or control.
Limitation of Liability
1. In consideration of the grant of Membership or Class Credits to you, you hereby release and forever discharge Perth Hills Pilates from all actions, suits, proceedings, claims, demands, losses, damages, penalties, fines, costs and expenses howsoever arising that you may have incurred arising from or in connection with your Membership and/or use of Perth Hills Pilates facilities and equipment, or from being on studio premises to the fullest extent permitted by law and whether caused or contributed to (directly or indirectly) by any act of negligence, breach of duty or default/omission on the part of Perth Hills Pilates and its respective owners, directors, officers, employees or agents.
2. In consideration of the grant of membership to you, you agree that Perth Hills Pilates will not be liable for any loss, damage or theft of any of your (or your guest’s) property except where caused by the gross negligence of Perth Hills Pilates. Further, Perth Hills Pilates will not be liable for any death, personal injury or illness occurring on club premises or as a result of use of facilities or equipment, except to the extent that it arises from the gross negligence of Perth Hills Pilates and its respective owners, directors, officers, employees or agents.
Privacy & Confidentiality Notice
1. During or immediately prior to your class, Perth Hills Pilates may obtain certain personal information (such as health and medical details). Perth Hills Pilates will only use, disclose and deal with such information internally and will not distribute or disclose your information to others.
2. All communications, emails, nutritional plans and any other document provided by Perth Hills Pilates are the intellectual property of Perth Hills Pilates and cannot be sold, copied, shared or redistributed without written permission. The information contained in this communication and any future accompanying documents/communications is intended for the use of the intended recipient only and may be confidential. If you are not the intended recipient of these communications, you are hereby notified that any unauthorized use, reliance, dissemination, disclosure or copying of communications/documents or any information contained in or attached, is strictly prohibited and may be unlawful.
- RULES AND REGULATIONS -
Code of Conduct
The mandatory Code of Conduct must be adhered to by Members to maintain a safe and enjoyable environment. Members should respect the health and safety of each other while on the studio premises and must comply with Occupational Health and Safety requirements of the studio. Any internal signage displayed around the studio forms part of the Membership Rules and Regulations and should be treated as part of the Code of Conduct. If a member is seen to be in breach of the Code of Conduct or Rules and Regulations, management reserves the right to terminate the membership and take further action if deemed appropriate.
Damage to Property
Any member who causes damage to equipment or any property of Perth Hills Pilates will be held liable for damages. Members will be held responsible for damage caused by children or guests.
Dress Code
Members must wear grip socks and be suitably clothed at all times for safety and hygiene reasons.
Equipment
All equipment must be replaced after use in all areas of the studio, in particular the replacement springs and props.
Guests of members
Guests may enter the studio premises on payment of a Casual Class, and on completion of creating a profile in Glofox and signing a studio waiver. Guests are subject to the Code of Conduct and the Guidelines, as notified from time to time on the Guest Register. All guests must be at least 12 years of age, be accompanied by you, and leave the studio at the same time as you do.
Hygiene and Cleanliness
Members must wipe down all equipment after use.
Storage
Storage cubes are provided for use ONLY while the member is training in the studio, and are used at the member’s own risk. While all care is taken, Perth Hills Pilates will not be held liable for any loss, damage or theft of belongings placed in storage or brought on the premises. Unclaimed property will be kept for 14 days and thereafter donated to charity.
Smoking
Members and their guests acknowledge that the studio premises, courtyard and veranda are a non-smoking environment.
Studio
Members are only permitted to access the studio under the supervision of a Perth Hills Pilates instructor or trainer.
The Rules and Regulations, and the interpretation thereof, are subject to change at management discretion. Members should ensure that they are familiar with the current Rules and Regulations applicable.
